Abstract
This article analyzes, from a socio-legal
perspective, notarial public faith in its
transition toward digitalization in Ecuador,
within a context of cultural, institutional, and
technological tensions that condition the
implementation of digital notarial acts. The
scientific problem lies in the fact that, despite
the constitutional recognition of universal
access to information and communication
technologies (Arts. 16, 17, and 385–388), the
regulation of electronic notarial services
remains fragmented, while notarial acts are
archived individually by each notary office,
without a national repository that would allow
for their centralized validation. This situation
creates uncertainty regarding their authenticity,
integrity, and legal validity. The objective of
the study was to analyze the sociocultural,
technological, and institutional factors that
condition the implementation of digital notarial
public faith. An exploratory-descriptive socio-
legal design was employed in Santo Domingo,
Province of Santo Domingo de los Tsáchilas,
between April and July 2026. The study
combined a documentary legal analysis of
primary legal sources, a dichotomous-response
survey administered to 20 participants, semi-
structured interviews with four notaries, and
triangulation of the findings using ATLAS.ti.
The findings show that 90% of respondents
have an active electronic signature; however,
95% perceive that public officials reject digital
formats in practice. The notaries acknowledge
the benefits of digitalization, although they
condition its adoption on the resolution of
economic, legal, and technical risks. The
normative analysis shows that electronic
signatures and certain electronic notarial acts
are legally recognized, albeit within a limited
scope and primarily through subordinate
regulations. It is concluded that notarial
digitalization constitutes a socio-legal
transformation rather than merely a
technological challenge. The findings, which
are exploratory in nature and not statistically
generalizable, support recommendations
concerning regulatory reform, the financial
sustainability of the fee structure, and the
development of interoperable technological
infrastructure.

problema científico reside no fato de que,
apesar do reconhecimento constitucional do
acesso universal às tecnologias da informação e
comunicação (arts. 16, 17 e 385–388), a
regulamentação dos serviços notariais
eletrônicos permanece dispersa, enquanto os
atos são arquivados individualmente em cada
cartório, sem a existência de um repositório
nacional que permita sua validação de forma
centralizada. Essa situação gera incerteza
quanto à sua autenticidade, integridade e
validade jurídica. O objetivo do estudo foi
analisar os fatores socioculturais, tecnológicos
e institucionais que condicionam a
implementação da fé pública notarial digital.
